When you need form CIV-110
At some point during a civil lawsuit, parties may reach a resolution or determine that continuing with the case is unnecessary. The CIV-110 Request for Dismissal form is used at this juncture to formally conclude the legal proceedings by requesting that the court to dismiss the case. This form is typically relevant once a settlement is reached between the parties, or if a plaintiff or petitioner decides not to pursue the case further. Additionally, it may be necessary to complete this form when a cross-complainant no longer wishes to continue with their claims.
Before reaching this stage, parties might complete the following forms:
- A settlement agreement outlining the terms of the resolution between parties.
- Motion to Withdrawal or other similar documents indicating the discontinuation of specific legal actions.
By filing the Request for Dismissal, parties can effectively notify the court that they no longer seek legal remedy, ensuring that court resources are efficiently allocated elsewhere. This step also prevents any further obligations related to the case from accruing, such as scheduled hearings or trials.
How to file form CIV-110
- 1. Obtain the Form: Start by downloading the CIV-110 Request for Dismissal form from the California Courts website or obtain a physical copy from the courthouse.
- 2. Fill Out the Form: Complete the form by providing all necessary details, including case number, names, and specifying the type of dismissal (with or without prejudice).
- 3. Submit to Court Clerk: File the completed form with the clerk at the court where your case was originally filed, typically the Superior Court of California in the relevant county.
- 4. Notify Involved Parties: If required, ensure all other parties involved in the case are notified of the dismissal request, and serve them with a copy of the form if required.
